High Court stays Bellandur lake proceedings in NGT

The Karnataka High Court on Thursday stayed all further proceedings in the Bellandur lake case before the Principal Bench of the National Green Tribunal in New Delhi.

BENGALURU: The Karnataka High Court on Thursday stayed all further proceedings in the Bellandur lake case before the Principal Bench of the National Green Tribunal in New Delhi. It is, however, not clear if the clean-up drive taken up by the agencies will also stop.

The division bench of Chief Justice Subhro Kamal Mukherjee and Justice P S Dinesh Kumar passed an interim order staying further proceedings in the NGT, New Delhi, after hearing the petition filed by Shashi Distilleries Private Limited, which runs a unit in Hulimavu village on Bannerghatta Road.

The distillery unit challenged the NGT’s April 19 order and also the order dated May 12 by the Karnataka State Pollution Control Board (KSPCB) for closure of the unit, on the ground that the Delhi Bench of NGT has no jurisdiction to hear the matter that comes under the jurisdiction of Southern Bench of NGT in Chennai.

Even otherwise, NGT should have followed the principles of natural justice by giving opportunity to the aggrieved parties before issuing closure orders, the petitioner contended.
