No Bail to Man who Mowed Down Child

The Madras High Court has refused bail to ND Karthi  of Sembium, who was arrested on the charge of riding a motorbike in a drunken condition and fatally mowing down a child on January 5 last.

The Madras High Court has refused bail to ND Karthi  of Sembium, who was arrested on the charge of riding a motorbike in a drunken condition and fatally mowing down a child on January 5 last.

According to Tirumangalam police, Karthi drove his motorcycle in a drunken state at an uncontrollable speed, lost control of the vehicle, dashed against a woman and a child standing in front of a marriage hall on January 5. While the child died on the spot, the woman sustained injuries. He was arrested on the same day.

Dismissing his bail application, Justice S Nagamuthu said that prima facie, it appears that the petitioner had knowledge as required under third limb of section 299 IPC that the act of driving the vehicle will result in an accident, killing a person, because, he was fully drunk. To that extent, knowledge can be attributed to the petitioner and thus, the offence would certainly fall within the third limb of Section 299 IPC making out an offence under Section 304(ii) IPC. “Having regard to all the above, I am of the view that this is not a fit case to grant bail to the petitioner.  Hence, Criminal Original Petition is dismissed,’’ the judge said.
