Director Kasthoori’s plea rejected

Madras High Court has rejected a plea from Tamil film director Kasthoori Raja to quash a cheque bounce case pending before the trial court in George Town.

Originally, financier S Mukanchand Bothra had lodged a complaint before the Metropolitan Magistrate-VII in George Town alleging that Kasthoori Raja had borrowed Rs 65 lakh from him in 2012. He issued a cheque for Rs 25 lakh in September, 2012,  which bounced.

The trial court issued summons to Raja. Aggrieved, Raja filed the present petition to quash the proceedings. Raja contended that Bothra could either conduct the case himself as the party-in-person or through an advocate and not through a power-of-attorney, as was being done.

Dismissing it, Justice R Subbiah said there was no law prohibiting filing of the complaint through a power-of-attorney.
