Jagan files second bail petition

Accusing Central Bureau of Investigation (CBI) of making discriminatory arrests in connection with the alleged disproportionate assets case, jailed Kadapa MP YS Jagan Mohan Reddy on Friday moved petitions in the Special CBI Court seeking his bail.

Jagan, who is under judicial remand at present and has been lodged in Chanchalguda Central Prison since his arrest on May 27, filed two separate bail petitions in the court.

In the petitions filed through his counsel, Jagan contended that it was his right under section 167(2) of CrPC to get a bail in relation to all offences in the case registered against him as the probe was not completed within 90 days from the date of his arrest.

Jagan said that he had fully cooperated with the investigation and would make himself available before the CBI as and when required.

This is the second bail plea filed by Jagan after the court had dismissed his bail petition on June 1 on the ground that he, being an MP and president of a political party, could tamper with the evidence and influence the witnesses.

“Being a law-abiding citizen, I will not make any inducement, threat or promise to any person acquainted with the facts related to the case to dissuade him from disclosing any information to the court or police,” the Kadapa MP said.

The counsel also said in the petition that though the FIR was registered on August 17, 2011, the central probe agency did not feel it necessary to keep Jagan in custody till his arrest that took place on May 27, 2012.

“ The CBI has made discriminatory arrests. The accused no. 6 in the case, minister Dharmana Prasad Rao, has been let free though it was alleged that he was instrumental in the commission of the offence.  It clearly shows that the investigation can be proceeded without taking the accused in remand,” the counsel said.
