‘Solar Commission acted within the provisions of law’

KOCHI: Justifying the findings in the report submitted by the Justice Sivarajan Commission which probed the Solar Scam, the state government on Monday submitted before the Kerala High Court the Commission had conducted its proceedings perfectly in accordance with the law.

The government filed the affidavit in response to a petition filed by former Minister Thiruvanchoor Radhakrishnan seeking to expunge the adverse remarks made by the commission against him.

According to the state, there were absolutely no legal grounds for the petitioner to challenge either the report submitted by the commission or any action initiated by the government on the basis of the report. The petitioner could not point out violation of any of the provisions of the law by the commission in its procedure. It did not violate any of the provisions of the Commissions of Inquiry Act 1952 and the principles of natural justice. The petitioner did not have any case the Commission had gone beyond the provisions of law while the inquiry was going on. The petitioner had fully participated in the inquiry accepting all the proceedings of the commission without any objection, according to the affidavit.
Meanwhile, the final hearing on the petitions filed by Oommen Chandy and Thiruvanchoor will be held on Wednesday.
