BJP MP claims SC action against Karnan has created 'Constitutional crisis'

The BJP MP has argued that actions against the judge could have only been taken by the Parliament.

NEW DELHI: The BJP’s Lok Sabha MP Udit Raj has claimed that the Supreme Court actions against the High Court judge CS Karnan have created “Constitutional crisis”. The BJP MP has argued that actions against the judge could have only been taken by the Parliament.

“By preventing the posts and functions of Justice CS Karanan, the Supreme Court has created Constitutional crisis.  Without completing the legal proceedings, criminal contempt is slapped on him, which could not have been done even with ordinary citizens. A judge is protected from such actions and only Parliament can act on such cases. Thus, apex court has created disturbance in the balance of power between judiciary, legislature and executive,” Raj said in a statement issued in the capacity of national chairman of All India Parisangh for SC/STs.

Raj, who represents the North-west Delhi Lok Sabha constituency, claimed that the article 214 and article 124 of the Constitution endows the power to impeach the judges of Supreme Court and High Courts with Parliament only. “Earlier. apex court took the power of appointment of judges from Parliament and now even the power to impeach is also being taken away. This has disturbed the balance between judiciary, executive and legislature. If Justice Karnan was guilty, then apex court should have taken the procedures as described in the Constitution,” added Raj in the media statement. He also stated that the apex court should have limited itself to conducting investigation only.
