MHA Consults Law Minister on Snoopgate Probe

The Ministry of Home Affairs is in consultation with the Law Ministry to finalise the members of the Commission of Inquiry, which will probe into the alleged snooping in Gujarat, Himachal Pradesh and Delhi.

The Commission is expected to submit the report in three months.

The probe will be carried out under Section 3 of the Commission of Inquiry Act, 1952. As per the Act, the Commission may consist of one or more members appointed by the appropriate government and one of them may be appointed as chairman.

“The appropriate government may, at any stage of an inquiry by the Commission, fill any vacancy, which may have arisen in the office of a member of the Commission (whether consisting of one or more than one member).”

The Commission will examine the circumstances leading to the surveillance by intercepting telephones.

Investigative website Gulail on December 24 released another 39 tapes claiming that the illegal surveillance was not limited to Gujarat but officials also tried to intercept a young woman’s Bangalore phone without proper authorisation, which was turned down by the Karnataka Government.

It will examine the roles of telecom service providers in Gujarat snooping scandal and probe into instances of unlawful interception of telephone calls in Himachal Pradesh and unlawful access to the call data records in Delhi.
