New Delhi, Oct 13 (PTI) The CBI today told the SupremeCourt that it had sought permission from a sitting judge ofthe Orissa High Court to "apologise" to him in a matterpertaining to an alleged attempt by its probe team to raid hisresidence.

The agency told a bench comprising justices A K Sikri andAshok Bhushan that the permission was cancelled as a matterrelating to the alleged incident was pending before the highcourt there.

"We had requested the judge of the high court to grant uspermission so that we can apologise to him. But it wascancelled because a matter was pending before the high court,"Additional Solicitor General Tushar Mehta, appearing for theCBI, told the bench.

Mehta also claimed that the CBI's team had not goneinside the gate of the residence of the sitting judge.

However, the bench observed that it could be a case of"mistaken identity".

The CBI has approached the apex court seeking transfer ofthe matter pending before the high court.

The Orissa High Court had recently issued notices to theCBI and the state police on a plea seeking a judicial probeinto the incident. The high court had sought responses on theplea filed by the bar association there.

During the hearing today, the apex court said that itwould hear the matter after the Diwali vacation.

A team of CBI officials had come looking for the house ofthe former judge of the high court. Another sitting judge ofthe Orissa High Court had shifted at the residence of theformer judge.

The police has said that on the basis of informationprovided by a security guard posted at the residence of thejudge, a case under IPC sections 448 (house trespass), 353 (todeter public servant from discharge of his duty), 511 (tocommit a cognizable offence) and 34 (common intention) wasregistered with the Cantonment police station here.
