CAT sets Sept 23 deadline for government on DGP's plea

The Hyderabad bench of Central Administrative Tribunal directed the state government on Friday to take a decision on the representation of director-general of police V Dinesh Reddy and report compliance by September 23.

Dinesh Reddy submitted a representation to the state government to continue him as DGP till end of September 2014 as he was given appointment in accordance with the Supreme Court directions in Prakash Singh’s case.

As there was no response from the government on his representation, he moved an application before the CAT. The tribunal directed the state government on August 28  to consider his case within two weeks. Then the government moved an application before the tribunal seeking more time to consider his case.

The bench, comprising justice P Swaroop Reddy and member (admn) PK Basu, asked special government counsel N Sreedhar Reddy to spell out the reasons for seeking extension of time. The counsel said the state wrote a letter to the Centre in July  on implementation of the apex court’s directions in Prakash Singh’s case. He said  the department of personnel and training said the matter was sub judice in view of the pending review of application of the Centre before the Supreme Court.

The government’s counsel submitted that the ongoing strike by APNGOs was another constraint for the government to take a decision in two weeks as directed by the tribunal and sought extension of time by two more weeks to take a decision.

V Venkata Ramana, counsel for Dinesh Reddy, opposed the plea and said that his client was due for retirement at the end of this month and if the government decided in the eleventh hour, his client would miss the opportunity to avail his legal remedies.
