Ordinance issued to transfer cases from AP Tribunal to HC

HYDERABAD: Telangana government issued an ordinance transferring the cases of service matters belonging to the state employees pending before the AP Administrative Tribunal to the purview of the Hyderabad High Court.
In an order issued on late Thursday night, the state government said it was issuing an ordinance being published in the extraordinary gazette of the State in this regard.
Earlier in the day, Telangana advocate general K Ramkrishna Reddy gave an indication in this regard before a division bench comprising Acting Chief Justice Ramesh Ranganathan and Justice U Durga Prasad Rao which was hearing petitions filed separately by P V Krishnaiah and B Kiran Kumar and another challenging the notification of the Central government issued on Sept 15, 2016, deleting the Telangana state from the jurisdiction of the AP Administrative Tribunal.
On earlier occasion, the bench sought to know the stand of the Telangana government with regard to 8,670 cases of Telangana employees pending before the APAT.
When the matter came up for hearing on Thursday, the AG submitted that when the Madhya Pradesh and Himachal Pradesh Reorganization Acts were formulated a similar situation arose wherein the respective governments came up with either a legislation or an Ordinance for transferring the pending cases in the Administrative tribunal to the High Court. Similarly, a decision will be taken by the state in the present case, he added.
Reacting to this submission, the bench said that the tribunal will hear the pending cases till an appropriate mechanism by way of legislation or ordinance is brought about. At present, none of the cases can be transferred in the absence of a mechanism.
When the bench specifically asked about the government’s action on the pending cases issue, the AG indicated that the government is proposing to bring out the Ordinance soon. The AG sought time to inform the court by tomorrow.
