Court directs Andhra government to implement Tribunal orders

The bench directed the chief secretary to file an affidavit in this regard and adjourned the case to August 28 for further hearing.

HYDERABAD: Wondering at non-implementation of the judicial order passed by Andhra Pradesh Administrative Tribunal (APAT) in 2001, a division bench of the Hyderabad High Court recently directed the chief secretary of Telangana state to file an affidavit giving undertaking that he will review all the cases, where the tribunal orders have become final and not been implemented so far, and ensuring that all those orders are implemented in a time bound manner. “The successful parties are forced to have one more round of needless litigation because of the government’s inaction,” the bench remarked.

The bench comprising Justice  C V Nagarjuna Reddy and Justice G Shyam Prasad was dealing with a petition by M Srinivasa Rao and 19 others complaining non-implementation of tribunal orders by authorities of medical and health department of Telangana.In the year 1999, the petitioners approached the APAT seeking regularisation of their services. In 2001, the tribunal passed an order directing the authorities concerned to take steps for regularisation of the services of the petitioners and payment of appropriate wages. Failure to implement these orders since 2001, the petitioners approached the High Court for relief.

After hearing the case and perusing the material on record, the bench while expressing displeasure at non-implementation of tribunal orders for the last 16 years, said that “Unfortunately, the successful parties before the tribunal are not able to enjoy their victory because of indifferent attitude of the officials. Such inaction of the officials in implementing the judicial orders mocks at the rule of law. This kind of situation is not proper,” the bench observed.

The bench directed the state chief secretary to take the initiative for bringing a change in the situation and to take steps for review of all the cases where the tribunal orders have become final and not been implemented so far, and ensure measures for its implementation in a time bound manner.
