Plea seeking construction work at night rejected

The Karnataka High Court on Monday directed the Bangalore  Builders and Developers’ Association to submit a detailed report on construction work without noise.

A division bench comprising Chief Justice Vikramjit Sen and Justice B V Nagarathna passed the order following an application filed by Sobha Developers and Bangalore Builders and Developers’ Association to change its previous order, according to which the builders should not take up construction work before 8 am and after 6 pm. The court had passed the order on a public interest petition challenging the construction work of an apartment in Sarakki Main Road at J P Nagar I Phase at night violating the National Building Code.

Justice Sen rejected the application seeking permission for construction work at night and further directed the real estate firm and the association to submit a detailed report on how construction work can be done at nights without noise. The bench later adjourned the case for further hearing.

The bench also directed the two Deputy Commissioners of Police (DCPs) of Bangalore  to be present before it on December 4 following the confusion over the timings of lorries which bring construction materials to the city.

The petitioners alleged that the state government had given permission to lorries to transport construction materials from 12 to 5 pm. However, while unloading, the lorries make noise.  But the government has given this timings so that people should not be affected by the traffic at night.

The bench directed the police officers to be present in the court and give details about the issue.
