High Court allows ACB to go ahead with graft probes

Giving green signal to the Anti-Corruption Bureau to go ahead with investigations in corruption cases, the High Court on Wednesday vacated the stay against the investigation in relation to 19.

BENGALURU: Giving a green signal to the Anti-Corruption Bureau (ACB) to go ahead with investigations in corruption cases, the High Court on Wednesday vacated the stay against the investigation in relation to 19 disproportionate assets and trap cases registered under the Prevention of Corruption Act.

Justice John Michael Cunha said there were no justifiable reasons to extend the stay. Moreover, there is an embargo on this court to stay investigations in cases registered under the Prevention of Corruption Act, the judge stated.

It has come as big relief to ACB as it can now continue investigation against errant officials including some KAS officers such as Nagahanumaiah, Special Land Acquisition Officer, BDA, Prakash, Deputy Director of Land Records, and others.

After the stay was granted in 27 cases, officials against whom ACB had registered cases started thronging the High Court seeking a stay by way of the interim order.  While challenging the FIRs registered against them, the petitioners had taken the ground that the ACB inspectors were not conferred police station powers to register crimes and they have only powers to investigate cases.
