The dual power centre issue is staring at the Travancore Devaswom Board, even as all eyes are on the High Court for a clarification. Experts point out that the government which failed to apprise the court of the constitution of the board well in advance is to be blamed on the embarrassing situation.
On Monday, the government, however, apprised the court that the new board has come into existence.
TDB Chief Devaswom Commissioner and former chief secretary K Jayakumar told Express that his post had ceased to exist once the new board came into existence.’ However, it is up to the government to apprise the court and seek a clarification on the issue,’’ he said.
The case is expected to be taken up on Wednesday or Thursday.
According to Section 30 of the Travancore Cochin Hindu Religious Institutions Act 1950, the Chief Commissioner is appointed in lieu of a board or when it ceases to exist.
The current issues started on the basis of the High Court order that the Chief Devaswom Commissioner will continue till the new board comes into existence or the end of the Sabarimala pilgrimage season whichever is later.
Based on the court order, the government had appointed Jayakumar in the post till January 31, 2013. However, it didn’t bother to inform the court of the constitution of the board on time and thereby avoid the present deadlock.
