High Court Disposes of KGS Group's Plea

KOCHI: The Kerala High Court on Wednesday disposed of a review petition filed by the KGS Aranmula International Airport Ltd seeking to review its order directing the Pathanamthitta District Collector to take necessary steps to restore the puramboku rivulet falling within the proposed Aranmula airport project area.

The KGS group submitted that they were not a party in the case and the company is a proper and necessary party to the proceedings and ought to have been heard before passing the judgment. The property involved is about to be assigned in their favour by the state government for developing the airport.

Justice A M Shaffique observed that the court order was a direction to the District Collector to take appropriate decision after hearing the affected parties. The petitioner is entitled to any direction from the government for assignment or to set aside the order by the land revenue commissioner to restore the ‘puramboku.’

The KGS group informed the court that the District Collector has not heard them so far. The court recorded the statement and observed that it is open to the KGS group to place the entire matter to the District Collector who shall take into consideration before proceeding with the matter.
