Verdict on Dileep’s bail plea tomorrow

The Angamaly Judicial First Class Magistrate Court will on Monday pronounce the verdict on the bail petition of actor Dileep, who has been languishing in the Aluva Sub-Jail after being arrested in the actress assault case.

KOCHI: The Angamaly Judicial First Class Magistrate Court will on Monday pronounce the verdict on the bail petition of actor Dileep, who has been languishing in the Aluva Sub-Jail after being arrested in the actress assault case.  The decision came after the completion of the arguments by the prosecution and counsel of the accused on Saturday. The hearing on the plea was completed by around 4.30 pm and the entire proceedings were held in-camera.  Earlier in the day, the court posted the hearing to afternoon following the request of the prosecution. Dileep filed the plea citing he had completed 60 days in judicial custody and, hence, was entitled to a statutory bail.

Judicial custody extended
The court has extended the judicial custody of Dileep till September 28. The custody of the actor was slated to end on Saturday.In his petition, Dileep said the first remand report submitted by the investigation team said the criminal conspiracy merely involved capturing nude pictures of the actress. The defence contended Dileep is not involved in the offence under Section 376 (D) (gangrape).  

Citing the remand report, which levelled 20 charges against Dileep, the defence said the agreement or object of conspiracy specifically pertained to the purpose of taking nude photos and videos. Hence, the charges of gangrape cannot be pressed against Dileep and he is entitled to bail since he has completed 60 days in custody.  The application is filed under section 167(2) (II) of CrPC, which states the accused person in custody for a total period exceeding to 60 days shall be released on bail.
