‘Files should be kept safe’

The first set of memorandum of writ petitions in each of the WP C Nos 9666/12 and 7221/12, were found missing from the court.

KOCHI: The first set of memorandum of writ petitions in each of the WP C Nos 9666/12 and 7221/12, were found missing from the court. Later, the second set was placed before the Bench in both cases when the cases were listed before the Bench on earlier occasions. Subsequently, it was also found missing.
At present, the court is considering the case using the third set of the writ petitions. Besides, the first set of memorandum of writ petition No 15974/ 2015 was also found missing and the court is having only the second set of the petition.

The court noted these files were missing only after listing the petitions before the other courts on May 21. However, the cases are listed before Justice Kumar for the first time. The court said the Registrar (Vigilance) shall be at liberty to go through the CCTV footage with the assistance of the experts, if necessary.

“This being the situation, the files shall be kept in the safe custody of the Registrar (Judicial) until further orders. Appropriate measures should be taken to ensure the safety and security of the High Court,” the Bench observed. The court also directed to place the order before the Acting Chief Justice for appropriate direction, if any, in the matter.
