Amnesty scheme to regularise unauthorised structures

ODISHA Government on Wednesday relaunched the ‘amnesty scheme’ for regularisation of unauthorised constructions in nine urban areas.

BHUBANESWAR:Odisha Government on Wednesday relaunched the ‘amnesty scheme’ for regularisation of unauthorised constructions in nine urban areas. Housing and Urban Development Department Minister Nirajnan Pujari announced the scheme notified as the “Scheme for Regularisation of Unauthorised Constructions, 2018.’’

“Any citizen intending to get unauthorised constructions regularised under this scheme has to apply to the Development Authority concerned within six months from today,” Pujari said, adding, “The applications received will be disposed of within 60 days. ““The scheme, however, is applicable only to such unauthorised constructions that are structurally safe and do not affect any public interest or safety or interfere with any public activities and do not contradict provisions of any other Act,” the Minister clarified.

In case of mega projects, Pujari said it is mandatory for the builder to obtain infrastructure development NOC from the municipal authorities concerned. To register a house under Zero Set Back, an applicant has to get NOC from the neighbour. For violation of norms in respect to front, side and rear set backs specified by the development authority concerned, the unauthorised constructions will be regularised by levying additional compounding fee against the existing charges.  For deviations in set backs in municipal corporation areas, the compounding charges will be 1.4 times more than the existing rate. Likewise, owners have to pay 1.3 times more than the existing fee in municipalities, 1.2 times more in NACs and 1.1 times more for buildings fixed by development authorities in rural areas.

Likewise, the compounding charges for establishments towards parking deficit per square metre will be Rs 10,000 for residential and Rs 17,o00 for non-residential buildings in municipal corporations; Rs 8,000 for residential and Rs 15,000 for non-residential buildings in municipalities; Rs  6,000 for residential and Rs 13,000 for non-residential buildings; and Rs 5,000 for residential and Rs 10,000 for non-residential buildings in rural areas.

On the other hand, officials said there is a formula to impose fine for deviation in Flor Area Ratio (FAR). “The rate for violation of FAR is linked to purchasable FAR, which in turn is linked to the benchmark value fixed by the authorities concerned.” Applicants would be required to submit four copies of building plans as per actual construction site showing site plan, layout plan, floor plan, four-side elevations, drainage and sewerage disposal plan duly signed by the plot owner or development authority and the architect or technical persons.

They would also be required to submit ownership copy of the land, site inspection report, fire safety clearance, structural safety clearance and other necessary clearances.Plot size up to 300 square metres will be considered for regularisation without insisting upon NOC from neighbours,  officials said, adding that clinical establishments would also get certain relaxations.

Meanwhile, the funds collected from this scheme would be credited into the CDP Infrastructure Development Fund (CIDF) and mainly be used for parking infrastructure in the development authority areas.Previously, the State Government had launched the amnesty scheme in 2008 which had fetched `18 crore.
