CHENNAI: THE first bench of Madras High Court has asked T Elangovan of Natham Colony in Dharmapuri district, who sought to transfer investigation into his son Ilavarasan's death in July, 2013 to a special investigation team (SIT), to wait till the fate of a similar case is known.
Ilavarasan, a Dalit boy, eloped with Divya, of a caste Hindu family, and later married her. Divya's father moved Madras High Court with a Habeas Corpus Petition. Following the submission of the girl that she would like to go with her parents, the court on June 6, 2013 had permitted it. While so, the body of Ilavarasan was found near a railway track behind the Dharmapuri Government Arts College on July 4, 2013.
Alleging that it was a clear case of murder and not a suicide, as claimed by authorities, Elangovan filed the present petition to transfer the probe into the death, to an SIT.
When the petition came up on Monday, the bench of Chief Justice SK Kaul and Justice R Mahadevan pointed out that in respect of a similar incident, it had passed orders directing the authorities concerned to look into all the three aspects with regard to payment of compensation to the parents of Ilavarasan, initiation of criminal proceedings against the persons, who allegedly murdered Ilavarasan and departmental proceedings against the officials for their alleged negligence and dereliction of duty.
"The present case relates to the same incident and seeks for transfer of investigation to SIT. We are of the view that once we have the compliance in respect of the directions issued in that (earlier) matter, this issue may be examined whether SIT may be necessary to carry out investigation," the bench said and posted the matter along with the similar writ petition, which is posted for compliance on September 9.
