CHENNAI: The plea for a direction to the CBI and the DRI to probe the allegation of payoffs offered to certain AIADMK MLAs during the confidence vote in the Assembly on February 18, is not maintainable, senior advocate R Krishnamoorthy told a division bench of Justices M Sathyanarayanan and M Sundar on Monday.

When the miscellaneous petition from DMK working president MK Stalin seeking CBI and DRI enquiry into the matter came up before the judges on Monday, Chief Minister ‘Edappadi’ K Palanisamy’s senior counsel Krishnamoorthy submitted that for the proper and effective adjudication of the issue involved in the main petition, which challenged the successful motion of confidence vote on the floor of the Assembly on February 18, the petition for impleadment and the direction sought therein are not maintainable, as they travelled beyond the scope of writ petition jurisdiction. He, however, sought time to file the counter.
The bench posted the matter for June 23.

In his miscellaneous petition, Stalin prayed for a direction to the CBI and the DRI to probe the sting operations conducted by two TV channels with regard to the alleged payoffs to some AIADMK MLAs during the floor test on the confidence vote in the Assembly on February 18.
Stalin’s main writ petition challenging the confidence motion is still pending.

Beyond the scope

The counsel said that for the proper and effective adjudication of the issue in the plea, which challenged the successful motion of confidence vote, the plea for impleadment and direction sought therein are not maintainable, as they travelled beyond the scope of writ petition jurisdiction.
