Do not alienate immovable properties, Radhika told

CHENNAI: A vacation judge has restrained actor Radhika Sarathkumar and her legal heirs, all partners of Magic Frames at Teynampet, from encumbering or alienating her two immovable property at T Nagar in Chennai.

Vacation judge R Mahadevan granted the interim injunction while passing orders on an application arising out of a civil suit from Radiance Media Private Ltd., by its authorised signatory N Srinivasan, at Nandanam, on Thursday. The judge also ordered notice on the main suit to recover Rs 2 crore from Radhika or to provide security.

According to Radiance Media, the plaintiff, Sarath Kumar and others, borrowed Rs 1.50 crore after executing an agreement for producing a film titled ‘Production No 4’ in November 2014 with 30 per cent interest. They promised to return it by March 2015. They did not keep the promise.
However, they approached the plaintiff again with a request to lend more money along with the outstanding loan amount and interest as per 2014 loan agreement and promised to execute mortgage deed for both the outstanding loan amount with interest and for the fresh loan.

Accordingly, Radhika executed a Mortgage Deed on January 21, 2016 for Rs 3.40 crore and the plaintiff lent the sum which includes the outstanding loan and interest in the following proportion namely, Rs 2.40 crore towards outstanding loan amount plus interest and a fresh loan of Rs 1 crore, totalling Rs 3.40 crore. This fresh loan was paid to the defendants represented by Radhika and the same was also acknowledged in the mortgage deed. But they did not keep this promise also. Hence, the present suit and interlocutory applications, plaintiff said.
