Tamil Nadu: October 31 date for decision on symbol row, Election Commission told

MADURAI: Observing that the Election Commission (EC) is not expected to keep proceedings on deciding the AIADMK ‘two leaves’ symbol row pending indefinitely, the Madurai Bench of the HC has directed the EC to dispose of the matter by October 31.
Disposing a PIL petition by an AIADMK cadre Ramkumar Adityan, a Bench comprising Justices K K Sasidharan and G R Swaminathan said this is more in the subject case on account of the direction given by the Principal Bench of the HC to government to hold elections to local bodies by November 17, 2017.
“Any delay in the matter would seriously hamper the functioning of the political parties,” the judges observed. Pointing out the fast approach of EC in deciding dispute involving the Samajwadi Party, the judges said that though the rival groups of AIADMK were responsible for delay, that cannot be the reason for keeping proceedings pending.
“The ECI must fix a deadline for completion of pleadings and production of documents for purpose of taking up the matter for final disposal”, the bench said. Further the judges directed the EC to dispose of proceedings in the dispute case filed by (the then) both factions of AIADMK, as per law, as expeditiously as possible and in any case, on or before October 31.
