Pondicherry Engineering College restrained from engaging staff till quota rule fulfilled

HC has restrained the College at Kalapet from engaging employees, either daily rated or on consolidated pay or on contract basis, till the posts earmarked for SC candidates are filled up.

CHENNAI: A division bench of the Madras High Court has restrained Pondicherry Engineering College at Kalapet from engaging employees, either daily rated or on consolidated pay or on contract basis, till the posts earmarked for SC candidates are filled up by following a transparent selection process.

In view of the direction given by the Supreme Court in Uma Devi case, the college authorities are restrained from regularising the services of helpers or employees working in any other non-sanctioned posts, in case those appointments were not through the employment exchange or by resorting to an open selection process, as envisaged under Article 14 and 16 of the Constitution, the bench of Justices K K Sasidharan and R Subramanian said.

The bench was disposing of a writ appeal from Puducherry chief secretary challenging the orders dated February 10, 2017 of a single judge. The bench, however, granted liberty to the affected persons to apply for age relaxation for appointment. Such applications should be considered favourably by the college.
