HYDERABAD: A division bench of the Hyderabad High Court on Monday made it clear that neither the revenue authorities of Telangana nor Navayuga Engineering company limited can enter the lands of private persons in Yellur village of Kolhapur mandal in Mahbubnagar district without consent even for a survey.

The bench comprising Acting Chief Justice Ramesh Ranganathan and Justice A Shankar Narayana passed the interim order in an appeal filed by Naga Jyothi and other villagers challenging an order of a single judge dismissing their appeal.

The counsel for appellants told HC that revenue authorities and company representatives were forcibly conducting survey of the appellants’ lands under the guise of proposed redesigning of Palamuru-Ranga Reddy LI Scheme without following  the  procedure  as  contemplated  under  Section  12  of  Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement  Act,  2013.

Alleging that the respondent authorities are still entering into the lands of appellants to carry out survey, the counsel urged the court to direct the respondents not to interfere with possession of the appellants.

Later, adjourning the case, the bench directed the respondents not to enter into the appellants’ lands and to file counter affidavits in the matter.
