HYDERABAD: It has been 18 days since the rules for the Real Estate (Regulation and Development), Act, 2016 have been issued but the state government is yet to put the Real Estate Regulatory Authority in place. Reason: The file is pending with chief minister K Chandrasekhar Rao.Builders cannot register in the absence of the Real Estate Regulatory Authority. It is mandatory that all the builders should register with the regulatory body within three months of issuance of rules.

As Constitution of the Real Estate Regulatory Authority is a lengthy process,  officials sent a proposal to the chief minister on temporarily appointing municipal administrative and urban development secretary as its chairperson. “The file is pending with the chief minister. Once the chief minister clears the file, the authority will come into existence and the work of registrations will commence,” sources in the municipal administration said.As per the Real Estate (Regulation and Development) Act, 2016, the selection of the chairperson of the authority should be given to a selection committee. The chairperson should be a retired person not below the rank of chief secretary or special chief secretary in the state government or additional secretary in the central government.

The selection committee will send the panel of two names for each vacancy to the government. The committee will make a recommendation to the government within 60 days. The government will, within 30 days from the date of receipt of the recommendation, appoint one of the two persons recommended by the selection committee as chairperson. As the process will take almost 90 days, officials have proposed the name of municipal administration secretary as chairman of the authority for the time being. Even this file has been pending with the chief minister.

It is mandatory for all real estate developers to register with the Authority for the ventures started in or after January 2017. “Once the chief minister clears the file, the authority will search for outsourced staff for processing the applications from real estate developers for registration,” an official explained.
As per the Central government’s directive, the rules for RERA Act should be framed, the Authority and the Tribunal should be constituted by July 31. “The state government has issued rules for the Act. But did not meet the deadline for appointing authority or tribunal,” sources said. 

APPELLATE TRIBUNAL
As far as the Telangana Real Estate Appellate Tribunal is concerned, officials said there is time for constitution of the Tribunal 
Sources said that as the Tribunal will not have much work, officials are contemplating entrusting RERA Tribunal job either to Endowments Tribunal or Telangana Sales Tax and VAT Appellate Tribunal
