Power of review of court order only in case of error: HC

HYDERABAD: The High Court has made it clear that the power of review may be exercised on the discovery of new and important matter or evidence. A bench of acting chief justice Ramesh Ranganathan and justice M Satyanarayana Murthy was dismissing a petition filed by the Progressive Constructions Limited seeking a review of the order passed by the court in 2014 where it was held that the impugned notices to the company issued by the commercial taxes department was in accordance with the AP Vat Act.

In 2014, the court held that the notices to the company for recovery of tax amount was in accordance with the Act. The company then filed a miscellaneous petition seeking a review.
Dealing with the review petition, court pointed out that there was an inordinate delay on the part of the petitioner. The power of review may be exercised where some mistake or error was found, the bench observed while dismissing the petition.
