Andhra Pradesh’s law on retirement age not applicable to Telangana: Hyderabad HC

HYDERABAD: A division bench of the High Court has made it clear that a law, which is made or amended by Andhra Pradesh or Telangana government, will not apply automatically  to both the states.
Accordingly, the amendment brought out by the AP government to the Andhra Pradesh Public Employment (Regulation of Age of Superannuation) Act, 1984, raising the age of superannuation of state government employees from 58 to 60 years will not be applicable to the employees of Telangana government, it has declared.

The bench of acting chief justice Ramesh Ranganathan and justice Shameem Akther was dismissing a petition filed by M Sarveshwar Reddy, an additional SP working in Telangana who sought directions to the state government to raise the age of superannuation on the ground that the Act 1984 was adapted under Section 101 of the AP Reorganization Act, 2014.
Petitioner’s counsel Vedula Srinivas contended that since the present AP state amended the Act 1984 with retrospective effect from June 2, 2014, and as the Act 1984 was adapted by the TS, it would apply to the TS and, consequently, all Telangana government servants were entitled to be continued in service till they attained the age of superannuation of 60 years. The bench held that Section 101 of the Act 2014 conferred power on the TS to adapt or modify a law in the erstwhile AP prior to June 2, 2014.
