CAT order on IAS promotion set aside

The Madras High Court has set aside the orders passed by the TN bench of the Central Administrative Tribunal , in February this year, which quashed a notification promoting R Nanthagopal to the IAS cadre.

A division bench of Justices Elipe Dharma Rao and M Venugopal quashed the CAT order while allowing a writ petition from Nanthagopal, questioning the order.

Originally, while passing orders on an application from G Mohanasundaram, the CAT in February set aside the notification promoting Nanthakumar to the IAS.

Aggrieved, Nanthakumar filed the present writ petition in the High Court.

Allowing it, the HC bench said that CAT, without analysing any of the contentions raised by Nanthagopal and Mohanasundaram, had passed the order on surmises and conjectures, ignoring the well-established principles of law, which could not be appreciated.
