Suicide Case: Accused Told to Surrender in Court and Seek Bail

In a major turnaround, the Ernakulam District and Principal Sessions Court on Monday ordered that the accused can get bail from the concerned Judicial First Class Magistrate after surrendering before the police in the case registered for the suicide committed by a housewife after the accused allegedly posted abusive comments against her on Facebook.

In a major turnaround, the Ernakulam District and Principal Sessions Court on Monday ordered that the accused can get bail from the concerned Judicial First Class Magistrate after surrendering before the police in the case registered for the suicide committed by a housewife after the accused allegedly posted abusive comments against her on Facebook. 

The court observed that it is true that the Case Diary (CD) revealed some abusive comments posted on FB by Ratheesh as having abetted the suicide committed by Vijitha at her house at Cheranalloor. In the CD, it is noted that on January 26, Vijitha’s son suffered an injury when his hand got stuck in the door of their house and for this, the deceased was scolded by her husband. It was soon after this that the woman committed suicide.

“The materials collected by the investigation officer do not show that  the comments on FB was the immediate reason for the suicide. It is true that the probe  has not been completed and one can’t say that the accused was responsible. However, from the CD, the court takes the view that a major portion of the probe has been completed. In such circumstances, custodial interrogation of the accused is not required.

“The court cannot accept the contention of the prosecution that the accused will influence the witnesses and tamper with the evidence. So the accused is eligible for bail,” the court ordered.

The court ordered Ratheesh to surrender before the investigation officer and after interrogation, he should be produced before the concerned Judicial First Class Magistrate who, in the event of moving the bail application by the accused, shall release him on bail, on execution of a bond of `50,000 with two solvent sureties.
