KOCHI: The state government on Monday approached the Kerala High Court seeking capital punishment to B K Biju, former private secretary of Power Minister Aryadan Muhammed, and another accused person in a case related to the murder of Radha, a housekeeper inside the Congress Block Committee office at Nilambur.
The state government submitted that the Sessions Court should have held that the offences of rape and murder alleged against Biju, who was also the office secretary of the Congress Block Committee office, and his close associate Shamsudeen alias Baputty, come under rarest of rare categories which warrants punishment nothing less than capital punishment.
A Division Bench comprising Justice V K Mohanan and Justice Raja Vijayararaghavan admitted the appeal filed by the state government and issued notices to the accused persons. The Additional District Sessions Court at Manjeri awarded life imprisonment to two persons.
The state government submitted that the sessions court did not take various factors including motive of the crime, impact of the crime on the society as whole, personality of the accused and the special circumstances of the case that the crime was committed by them for satisfying their sadistic pleasure. Instead, the court without considering any of the factor simply awarded punishment with an observation that every murder is heinous, the state submitted.
