2G accused challenge HC order

The SC was moved on Monday by Swan telecom promoter Shahid Usman Balwa and other accused, challenging the order of a Bench headed by Justice Singhvi which had stayed proceedings on all cases linked to the 2G spectrum case before the Delhi HC.

Senior counsel Ram Jethmalani and Rajeev Dhavan mentioned the matter for urgent hearing before a three-Judge Bench comprising Chief Justice Altamas Kabir, Justice S S Nijjar and Justice J Chelameswar.

The petitioners sought stay of orders of the Bench headed by Justice Singhvi which had ruled that no court other than the SC shall entertain any application relating to the case. The Bench said that it would go through their averments and documents in the chamber and decide on giving them a date for hearing.  Apart from Shahid, Vinod Goenka, promoter of Swan Telecom, and Asif Balwa and Rajiv Aggarwal, both directors of Kusegaon Fruits and Vegetables Pvt Ltd, moved the SC.
