Unnao rape case: FIR registered against BJP MLA Kuldeep Singh Sengar, no decision on arrest

The MLA has been booked under various sections of the Indian Penal Code (IPC) and provisions of the Protection of Children from Sexual Offences (POCSO) Act.

LUCKNOW:  After submission of the preliminary inquiry report by Special Investigation Team (SIT) on late Wednesday evening, Unnao police on Thursday morning lodged an FIR against BJP MLA Kuldeep Singh Sengar under various sections of IPC and Prevention of Children from Sexual Offences (POCSO) Act on complaint of the mother of girl who had accused the MLA of rape, intimidation and physical assault. 

However, the state government, on late Wednesday night, recommended a CBI probe into the entire incident including  rape, assault on vicitm’s father and his subsequent custodial death. The government decided to hand over the case to premier investigation agency after examining and analysing the SIT report submitted by ADG, Lucknow zone, Rajiv Krishna.

Meanwhile, the erring MLA has been booked under Sections 376 (rape), 366 (kidnapping, abduction, inducing woman to compelling her for marriage), 363 (kidnapping) and 506 (criminal intimidation).
Despite the case being lodged, the possibilities of Sengar’s arrest anytime soon seem remote. According to Principal Secretary, Arvind Kumar, since the case has referred to the CBI, the future course of action would be decided by the probe agency itself.

However, till the time CBI takes over the investigation, UP police would continue the inquiry. While interacting with media persons, the principal secretary claimed that the CBI would now decide as to when the MLA would be arrested on the basis of the merit of the case after investigation.
Clearing the air further, both Principal Secretary, home, Arvind Kumar and DGP OP Singh refuted the allegations of shielding the MLA and claimed that CBI probe was ordered to maintain the transparency of probe. 

On why the girl had not named the MLA in her magisterial statement in June, 2017, the officials said that she did so fearing for her life as she claimed before the probe team. 

“Besides, the government has also decided to extend  security to the family of the rape survivor,” said DGP OP Singh.

While the victim has questioned the delay in MLA’s arrest apprehending further intimidation of her kin, another report has been submitted by DM Unnao on the lapses by district hospital authorities in the treatment of victim’s father who succumbed on Monday.  

Consequently, two doctors namely Dr DK Dwivedi (chief medical superintendent) and Dr Prashant Upadhyaya (EMO) were suspended with immediate effect. Moreover, disciplinary action was initiated against three other doctors – Dr Manor Kumar, Dr GP Sachan and Dr Gaurav Agarwal—for slackness in giving adequate medical care and proper treatment to the deceased.

Meanwhile, the axe of suspension has also fallen on CO, Safipur police station area, Kunwar Bahadur Singh for negligence in handling repeated complaints given by the victim.

However, while his interaction with media persons, UP DGP OP Singh had some embarrassing moments to face when he was questioned on addressing the accused MLA as ‘Manniya’ (honourable). He justified it by claiming that the charges against the MLA were yet to be established. “He has only been charged not proven guilty till now,” said DGP Singh.
