HYDERABAD: Despite being promoted six to seven times in their career, the state government cited ‘stagnation’ as the reason for elevating the IPS officers belonging to the 1977 batch, who include director general of police K Aravinda Rao to the DGP cadre, said J Sudhir, counsel of principal secretary P Gautam Kumar, who challenged the appointment of Aravinda Rao in the Central Administrative Tribunal (CAT).

In his argument against the appointment in CAT today, Sudhir informed it that the state elevated them though there were no vacancies. It was nothing but violation of rules. “The state government was wrong on both factual and legal aspects,’’ he said.

The alleged illegal appointment of handpicked IPS officers to the posts of DGP (Head Of Police Force) has been costing the state exchequer dearly. The government has to spend Rs 60 lakh for meeting various legal expenses, which includes payment of fee to a Delhibased lawyer, to defend its decision of appointing RR Girish Kumar as DGP by replacing SSP Yadav in CAT.

Girish Kumar was appointed as DGP by increasing the DGP cadre posts from two to three. The government should obtain prior permission from the Union government for increasing the DGP cadre posts. But in Girish Kumar’s case, post facto permission was taken after the then chief minister K Rosaiah made a personal request to Union home minister P Chidambaram to save himself from embarrassment, Sudhir said.

“The elevation of several IPS officers of 1977 batch to the DGP cadre is a worst case when compared to that of Yadav versus Girish Kumar because this time the state government did not even send a request to the Union government for post facto permission,’’ Sudhir added.

He also quoted the CAG report which took objection to creation of additional cadre and ex-cadre posts in various states as it is imposing an additional burden on the state exchequer. “The state government’s stand of elevating 1977 batch IPS officers based on 4 (2) of IPS Cadre rules is not justifiable,” Sudhir argued.
