BANGALORE: The High Court on Wednesday ordered the 157 occupants of a 3.38 acre plot belonging to the Lakshmi Janardhana Swamy temple in Mandya to clear all outstanding dues which was pending since 2004 and vacate the place within 18 months.

The division bench comprising Chief Justice J S Khehar and Justice Ashok B Hinchigeri heard a writ petition filed by former MLC M D Ramesh Raju and others, who had built hotels and shops in the land in survey no 184 in the heart of Mandya city, belonging to the temple. The petitioner stated that they have been staying in the place for more than 25 years and cannot vacate the place now.

To this, the HC division bench remarked, “Whoever has obtained benefit from the state government should pay for it... You had obtained the place on lease for a term, and must vacate when it gets over.” The bench also ordered the petitioners to pay their dues on or before August 31, and vacate the place by January 31, 2014. It added that any violation of the court order by the petitioner will be treated as contempt of court and, hence, be liable for criminal prosecution.

24 tenants had occupied the land on lease about 25 years back, who had subleased it to 157 others.

Stay on Road Widening in Tumkur

The High Court on Wednesday ordered the stay on the widening of the Mahatma Gandhi Road in Tumkur.

Nagaraj Shetty and others had filed a petition in the High court, and in their submission, they had stated that without prior notice, the Tumkur City Municipal Council has slated demolition of the building.

Hearing this petition, the single Bench of the High Court ordered a three-week stay on the demolition work.
