The Ernakulam Chief Judicial Magistrate Court on Monday remanded two CPM leaders, Karayi Chandrasekharan and Karayi Rajan, seventh and eighth accused in the Thalassery Fasal murder case, in CBI custody till Thursday.
Magistrate P Sasidharan passed the order after the Kerala High Court upheld the decision to remand the two accused in CBI custody. The magistrate had granted seven days custody, but on the same day the High Court stayed the order.
Justice S S Satheesachandran on Monday lifted the interim stay and asked the Chief Judicial Magistrate to hand over them to the CBI.
The court dismissed the plea challenging the remand in CBI custody. Counsel for the petitioner M K Damodaran submitted that an accused who was remanded under section 309 (2) CrPC could not be given in custody.
