HC stays eviction of couple

For Rachelamma and Samu, it was a matter of survival. And they were not in a position to wait for the service of a legal expert to present their grievances before the Judiciary. The couple from Eroor in Kollam approached the High Court on Wednesday as a last resort against the eviction by a bank. The duo, appeared before the court personally, and earned a favourable order.

The court stayed the proceedings initiated by Syndicate Bank against the couple who were forcibly evicted from their house. The court directed that the possession of the buildings shall be restored.

Justice P R Ramachandra Menon passed the order when the duo appeared in person informing that the advocates were on a strike.

The petitioners submitted that due to personal problems, the payment ordered by the court earlier could not be effected on time. “The delay occurred in view of the immediate necessity to raise funds in connection with the treatment for cardiac ailments of the petitioner. Despite that, they had paid `25,000 to the bank,” the court said.

After the treatment, the petitioners realised `50,000 from other sources and went to the bank. However, the amount was not accepted, and they were forcefully evicted from the premises on Sunday, the petitioners said.
