KOCHI: A Division Bench of the Kerala High Court on Tuesday upheld a Single Bench’s order, stating that the police were absolutely free to hand-cuff an accused if they apprehend his escape, either on account of force used by him or with the help of others from outside.
The Bench, comprising Acting Chief Justice Ashok Bhushan and Justice A M Shaffique, passed the order while dismissing a appeal filed by Bineesh, a convict in the Kanichukulangara fake accident case, seeking a directive not to hand-cuff under-trial prisoners while going to courts and returning.
