CUTTACK: The Orissa High Court today started hearing on the admissibility of the writ petition filed by former additional judge of the Court Lalit Kumar Mishra, who has been slapped with compulsory retirement for not joining his position as district judge, Kalahandi, following his reversion.

Mishra had moved the petition challenging the reversion and seeking appointment as a permanent judge of the High Court.

The division bench comprising Chief Justice V Gopalagowda and Justice HS Bhalla has adjourned the case to December 16 while directing Assistant Solicitor General SC Das to take instructions from the Central Government on the matter and the registry of the High Court to make all records available on the next date of hearing.

Mishra had filed the petition seeking quashing of the order of his ‘deemed reversion and compulsory retirement’ passed by the High Court on the basis of the liberty granted to him by the Supreme Court.

The High Court had not recommended him for appointment as permanent judge following completion of two years as additional judge in the court.

Mishra had been elevated as additional judge of the Orissa High Court on January 17, 2008 after 15 years as district judge along with Justice BK Patel. In his petition, he alleged that the then Chief Justice of Orissa had recommended his appointment as permanent judge in May 2009.

The recommendation was also approved by the Supreme Court and sent to the Central Government. But he was reverted back to the position of district judge while Justice Patel became the permanent judge, he alleged.
