No Case Against Minister at Time of Passport Issue: RPO

CHENNAI: No criminal proceedings were pending before State Fisheries Minister KA Jayapaul when a passport was issued to him, the Regional Passport Officer (RPO) clarified on Monday.

In a public interest writ petition, G Kaliyamurthy of Ukkadai in Tiruvarur district had alleged that Jayapaul had been arraigned as an accused in a case relating to a group clash at Akkaraipettai in November 2006 and a final report was filed before the Judicial Magistrate in Nagapattinam. Jayapal had obtained a passport under the tatkal scheme in 2012 by suppressing the fact of the pendency of the case and had also given a false address as his permanent address, the petitioner further alleged.

When the matter came up before the bench on Monday, a copy of a letter dated August 26 from the RPO was produced before the first bench of Chief Justice SK Kaul and Justice M Sathyanarayanan. The letter stated that no criminal case was pending before the minister at the time of issuing the passport. It was true that a case had been registered against Jayapaul. After a probe, the final report was filed before the JM in Nagapattinam and it was taken on file on March 14 this year. On the date of issue of the passport, there was no cognizance taken in any case by any court in Nagapattinam against him. Moreover, the Madras High Court, by an order dated April 25 this year had quashed all further proceedings on the case pending before the Nagapattinam JM. On April 30, the JM, discharged all the accused, including Jayapaul, and closed the case, the letter added.
