CHENNAI: A Division Bench of the Madras High Court has issued notice to the authorities concerned on a habeas corpus petition from Mathaiyan seeking to produce his daughter Valarmathi (23) in the court and to set her free.
The Bench of Justices A Selvam and P Kalaiyarasan ordered the notice to the State Home Secretary and the Salem police commissioner on Thursday, returnable by August 7. Valarmathi, a suspended post-graduate student of journalism in Periyar University, Salem, was arrested on July 13 for participating in agitations against the hydrocarbon project at Neduvasal as well as the laying of ONGC pipelines at Kadiramangalam.
Salem police commissioner issued the detention order under the Goondas Act on July 17. In his habeas corpus petition, Mathaiyan submitted that the detention of his daughter was malice in law. People had the right to protest peacefully and same was protected under 19(1)(b)(c) of the Constitution, he said.
