OPS files caveat in Delhi High Court

A day after the Delhi High Court refused to give ‘hat’ as election symbol to T T V Dhinakaran, Deputy Chief Minister O Panneerselvam on Tuesday filed a caveat in the court.

NEW DELHI: A day after the Delhi High Court refused to give ‘hat’ as election symbol to T T V Dhinakaran, Deputy Chief Minister O Panneerselvam on Tuesday filed a caveat in the court.

Caveat is a legal notice to a court to suspend a certain proceeding until the notifier is given a hearing, and it means that no order can be issued against Panneerselvam faction without hearing them first. It is put to practice when a party anticipates that someone will go to court against them.

On Monday, the court had dismissed the interim plea of Dhinakaran to get ‘hat’ symbol allotted for RK Nagar bypoll, while leaving the decision in the hands of Returning Officer of the Election Commission to allot the symbol to Dhinakaran as an independent candidate for the bypoll to be held on December 21.
On November 30, Dhinakaran had approached the Delhi High Court challenging the Election Commission’s order in the ‘Two Leaves’ symbol case.

The poll panel had allotted the AIADMK symbol to the Panneerselvam faction. The seat fell vacant after the death of former Chief Minister J Jayalalithaa in December 2016.
