Retired judge to hold extraordinary general body meeting of Andhra Club

CHENNAI: K P Sivasubramaniam, a retired judge of the Madras High Court, has been appointed as Judge-Commissioner to hold the extraordinary general body meeting (EGM) of Andhra Social & Cultural Association, known as Andhra Club, at T Nagar here.

Justice N Sathish Kumar made the appointment on July 24 last while disposing of a batch of civil suits and applications from S Seshadri and three others, levelling various allegations, mainly regarding induction of new members, against the association office-bearers.

After hearing the submissions of advocate S Thankasivan and others, the judge observed that all was not well and not acted as per law. “Therefore, I am of the view that admittedly 89 members  were made as members as the son or son-in-law of the existing members.

But, in fact, they are neither son nor son-in-law of the members. Therefore, when such people become members in utter violation of bye-laws, they cannot have any say in this suit until a proper extraordinary general body meeting is conducted in a proper manner to take a decision as to whether or not to regularise those members. The right of the members, who are inducted under the children’s quota will also be decided only by the EGM, subject to the majority view of the meeting,” the judge added.

The judge also observed that “In view of all these facts, this court is of the view that unless a fresh EGM is called to decide the right of the above persons, the members, who have come through back-doors cannot have any say. Their right has to be decided in the EGM,” the judge said.
