CHENNAI: The Madras High Court has adjourned a petition filed by the Income Tax Department against actress Trisha for further hearing next week. The first bench, comprising Chief Justice Indira Banerjee and Justice M. Sunder, adjourned the petition yesterday and posted it for June 13.
The petition was filed by the Commissioner of Income Tax Central Circle challenging an appellate tribunal order confirming the order of the Commissioner of IT Appeals.
The order had cancelled the Rs 1.11 crore fine imposed on the actress for not furnishing details about her income in 2010-2011.
The actress in the early stages of the assessment had not disclosed the amount received from some people as income but only as advance amount.
The Assessment officer had levied the penalty under Section 271(1)( C) of the Income Tax Act, stating she did not disclose the amount as income in the earlier stages of assessment but filed the revised returns during the course of assessment proceedings.
The above section stipulates that when there is furnishing of inaccurate particulars or concealment of income by the assessee, a penalty ranging between 100 to 300 per cent can be levied by the assessing officer.
The actress challenged it before the Commissioner of IT Appeals who cancelled the fine. The tribunal had also confirmed the order, following which the IT department moved the court, seeking the appellate tribunal order be cancelled.
