Detention order: High Court slaps Rs 25,000 fine on Chittoor SP

For passing detention orders contrary to provisions of (PD) Act, a division bench of Hyderabad HC has imposed a fine of Rs 25,000 on Chittoor SP.

HYDERABAD: Expressing displeasure with the authorities for passing detention orders contrary to provisions of Preventive Detention (PD) Act, a division bench of Hyderabad HC has imposed a fine of Rs 25,000 on Chittoor SP.

The bench of Justice Suresh Kumar Kait and Justice U Durga Prasad Rao was dealing with the petition filed by the wife of the detainee Ajay Kumar seeking to quash the detention order of district collector and magistrate, Chittoor which was confirmed by AP government.

According to the petitioner, the detention order and grounds on which it was issued were served in Malayalam as her husband is from Kerala. Rest of the documents were supplied in English or Telugu, not known languages of the detainee.

The respondents conceded that the relied upon documents were served either in English or Telugu, but not served in Malayalam. However, the detainee was explained every document, they contended. Not satisfied with the submissions of respondent, the bench observed “time and again, the SC and different HCs have reminded the detaining authorities that the documents relied upon have to be supplied in vernacular language or the language known to the petitioner.”

While quashing the detention order, the bench imposed costs of Rs 25,000 on the SP.
