Dealer to pay Rs 3 lakh for wrong delivery of car

The complainant claimed that the dealer acted in a deceitful manner and delivered a car of the lesser value version in lieu of a higher value car, thus causing her monetary loss.

HYDERABAD: Consumer Forum asks Nissan dealer to deliver the car of choice in roadworthy condition to the buyer, an elderly woman Nearly three years after filing a case with Hyderabad District Consumer Disputes Redressal Forum-III against a car dealer for deficiency in service, a 75-year-old woman has been awarded Rs 3,05,000 towards compensation in addition to delivery of the said car in a roadworthy condition.

The complainant, had paid advance and booked ‘Nissan Evalia XV Upper Version’ from  Dhanalakshmi Automotives India Private Limited in Nov 2013 but was delivered a Nissan Evalia XV basic features model, which costs Rs 11 lakh, over a lakh and a half less than what she had paid for.

She claimed that the dealer acted in a deceitful manner and delivered a car of the lesser value version in lieu of a higher value car, thus causing her monetary loss.

The dealer denied the claims. Terming it a frivolous complaint, the respondents requested the forum to dismiss the complaint and sought a compensation of `10,000 from the complainant for making a frivolous complaint.

After going through all evidence, the forum found deficiency of service and decided that the complainant was entitled to a reasonable compensation. It directed the dealer to pay Rs 2 lakh as compensation, Rs 1 lakh as expenditure incurred by the complainant since Jan 2014 and Rs 5,000 towards costs along with the subject car in a roadworthy condition.
