BANGALORE: Senior counsel and former Advocate General R N Narasimhamurthy objected to the single bench proceeding with the hearing of a petition challenging land acquisition for the metro project.

On Tuesday, Narasimhamurthy raised an objection before Justice D V Shylendrakumar that it was contrary to the roster system assigned by the chief justice. "This bench has no jurisdiction to hear the petition as per the roster system," he submitted. "As per the SC order, the CJ assigns the roster to judges of the high court, so this bench has no jurisdiction to take up the hearing," he stated.

Recording the submission of the senior counsel, the bench granted two days time to seek appropriate remedy. Earlier, the court directed the state government and the BMRCL to produce original records of the metro project. The court also directed the BMRCL to produce its balance sheet since its inception. M/s SK Enterprises Limited and seven others challenged the construction of South End metro rail station. The petitioner contended that the KIADB acquired more land than what was actually needed. In an another petition, Naveen Hotels Limited and Firebrick and Potteries Limited, challenged the acquisition of three acres of land for Yeshwantpur metro station.

HC stays case against forensic lab director

The High Court stayed the investigation against BM Mohan, Director, Forensic Science Laboratory (FSL) in connection with a criminal case filed at Madiwala police. While hearing the petition of Mohan, Justice V Jagannathan stayed the investigation for four weeks. Sridhara, one of the candidate for the post of scientific assistant filed a criminal case against Mohan after his application for the post was rejected. In the petition, Mohan challenged the complaint stating that he was falsely implicated.

HC adjourns five Independent MLAs case

The full bench of the High Court adjourned the hearing of the petition of five Independent MLAs to January 27. Satyapal Jain, the counsel appearing for the chief whip of BJP argued before the full bench that once an Independent MLA was inducted into the Cabinet, he no longer remained independent. The full bench adjourned the hearing to January 27.

Appoint adequate doctors to govt hospitals: HC tells state

Taking strong exception for not appointing adequate doctors to the state's government hospitals, the High Court directed the state government to appoint doctors on rational basis before April 2011.

While hearing the PIL seeking direction to appoint doctors to Muddebehal government hospital, the division bench directed Ramana Reddy, Principal Secretary of the Department of Health and Family Welfare to evolve a criteria to appoint doctors to all government hospitals on rational basis before February 28, 2011.

The court adjourned the hearing to April 15, 2011.
