CHENNAI: The Madras High Court has granted the plea of relatives of former Assembly Speaker K Kalimuthu to attach the latter’s properties in Madurai in lieu of a loan borrowed by him.
In their application, Krishna Ponnuswamy and Nirmal Kumar submitted that Kalimuthu borrowed Rs 25 lakh in May 2006. But, he died on November 8, 2006. The applicants approached the legal heirs of Kalimuthu. As they refused any liability, a civil suit was filed in the HC praying for a direction to the heirs to pay Rs 27.35 lakh with 12 per cent interest per annum.
They also filed an application praying for an order of attachment of the properties measuring 0.92 cents, a petrol bunk in Madurai and the property of Manohari Kalimuthu, second wife of Kalimuthu, in Sree Nagar.
The defendants submitted that after the death of their mother Nirmala Kalimuthu, who was the owner, the properties devolved upon them. Hence, they were not under the obligation to repay the loan. Justice K Chandru observed that the plaintiffs had established a prima facie case regarding the loan taken. They had made it clear that the no objection certificate was given by the whole family for running the bunk. So, they were entitled to succeed.
EVM inspection: An inspection of the electronic voting machine (EVM) will be held at the Election Commission in New Delhi on August 27. PMK president GK Mani was to point out the defects he found in the EVMs, the First Bench comprising Chief Justice HL Gokhale and Justice D Murugesan said on Wednesday.
