Exam cancellation: SFMCs approach HC

Kerala Private Medical College Management Association approached the Kerala High Court on Tuesday, challenging the order issued by the Admission Supervisory Committee for Professional Colleges cancelling the entrance examination held in Kozhikode for admission to management seats for MBBS.

The committee, headed by former judge J M James had found prima facie evidence of corruption and malpractice in the conduct of the test and therefore cancelled it.

According to the petitioner, the examination was conducted under the supervision of the Admission Supervisory Committee.

There was a commotion outside the examination hall, but it had not affected the conduct of examination or the quality of the examination, said the petition. The committee ordered cancellation of the examination held by the association on May 31 and directed the Commissioner for Entrance Examinations to conduct the examination on June 22.

The petition stated that the management has the right to decide whether an examination is to be conducted and the committee is only to supervise this.

Further, it states no body has the power to conduct the examination after May 31 of an year and to declare the results after June 15 of the said year. The decision was against the law and principles of natural justice, it is alleged. On the basis of the agreement entered into with the government, the entrance test was to fill up 35 per cent of the seats in the eight member colleges, totaling 314 seats.

After the notification was issued and the prospectus was published, the controller of examination appointed by the petitioner association had received 1,319 applications. As many as 917 candidates had appeared in the examination, which was conducted as per the committee’s directions under the supervision and control of Anirudhan, who is a member of the Admission Supervisory Committee, with the assistance of Dr Beena of Medical College, Kozhikode, the petition stated.
