Sub-Inspector Post: KAT Directive to PSC Secretary

The Kerala Administrative Tribunal (KAT) has directed Kerala Public Service Commission secretary P C Binoy to appear before it in person on April 11 in connection with a contempt petition against the non implementation of the Tribunal’s order with regard to a case related to the post of Sub-Inspectors.

“Even after repeated directives, we found that the PSC did not communicate to the applicant on its decision taken as per the directives of the tribunal.

“Accordingly the PSC secretary has been directed to appear in person before the tribunal on April 11,” said KAT chairman K Balakrishnan and member S Pradeep Kumar Naidu in the order.

The order was pronounced in a petition filed by an applicant Mohammad Thaha, who was represented by advocate Vazhuthacaud R Narendran Nair.

The KAT, in its order on August 7, 2013, had instructed the PSC to re-examine within six months a video recording related to the physical efficiency test conducted for the post of Sub-Inspectors, in which Thaha had failed.

The KAT had directed that the re-examination be done with the help of experts and members who were not parties in the earlier examination.

The Tribunal said that the complainants’ claim for inclusion in the rank list should be considered in accordance with established procedures in case the result is in favour of the petitioner.

It also said that the long cherished dream of an applicant should not be shattered by the inaccurate assessment by officers. 

The petitioner had alleged that he was wrongly declared failed in the ‘Long Jump’ event while he had cleared other four items in the physical test.  

Though the PSC had filed a statement before the Tribunal denying the claims of the petitioner, the KAT said: “On examining the videos, in the presence of both sides, we prima facie felt that the applicant cleared the long jump in the third attempt”.
