NEW DELHI: Former Prime Minister Deve Gowda has thrown yet another spanner in the works of Nandi Infrastructure Corridor Enterprise (NICE), which is executing the Bangalore- Mysore Infrastructure Corridor project.

Gowda filed an additional affidavit in the apex court on Monday alleging that Advocate General of Karnataka and NICE had carried out collusive proceedings on October 27, 2009, to obtain an interim order dated November 3, 2009, from the apexcourt and that the same needs to be recalled.

He contended that the petitioner NICE and the Advocate General should be punished for criminal contempt of the court for their “conscious acts of collusion”.

Gowda further felt that the order passed by the Karnataka High Court asking the Lokayukta to carry out a probe has to be upheld.

Towards this, the interim order passed by the Supreme Court on February 20, 2009 needs to be vacated, he said in the affadivit.

The former Prime Minister averred that the government represented by the Advocate General and NICE were trying to overreach the apex court and to mislead it in order to get orders passed in violation of its judgment.

This is evident from the letter of NICE dated 16-11-2009 requiring to abandon the stand taken by the state on affidavit to implement the project as per the Karnataka High Court verdict and confirmed by the apex court and instead now provide lands component wise as per the ODP and not as per para 51 of Somashekhar Reddy’s judgment.
